The Record
(A) All documents and other evidence offered and taken shall become part of the record. The
record shall further contain recordings or transcripts of the proceedings and all exhibits and
documents introduced at the hearing and, wherever applicable, medical documents obtained to
resolve medical issues. The record shall be the exclusive source of the hearing officer's decision.
For purposes of judicial review, the record shall also include the decision.
(B) All evidence and testimony at the hearing shall be recorded electronically.
(1) At the discretion of the hearing officer, any party may record the hearing.
(2) Regardless of whether an appellant intends to file a Complaint for Judicial Review,
transcripts or recordings of the proceedings shall be supplied, upon request by the appellant,
at his or her expense. The record shall be open for inspection by any party or his or her
authorized representative during the regular business hours of DOH.
