Timeliness Standards

The Department shall provide written notice to the individual suspected of an Intentional Program Violation (IPV) at least 30 days in advance of the Administrative Disqualification Hearing (ADH). ADH decisions shall be made within 90 days of the date of the notice. The Department must implement the ADH decision effective beginning the first possible month following the date the individual receives written notification of the decision, consistent with the requirements of 106 CMR 706.305.
