Special Provisions for Fee-paying Clients
When a fee-paying Appellant requests a Fair Hearing, the Hearing Officer shall include in
the decision an order relative to the recoupment of fees as set forth below:
(1) If the Appellant's challenge to the fee is successful, any extra fees paid shall be refunded
within 14 days of the decision.
(2) If the Appellant's challenge to the fee is unsuccessful, the Appellant shall be notified that
he or she must pay any fees owed within 14 days of the decision, and that failure to pay such fees
shall result in a termination of service without further hearing. 110 CMR 10.32 in no way
negates the Appellant's obligation to continue to pay any pre-established fees pending the
outcome of the hearing.
