Court-prescribed Services, without Custody to Department
(1) Where a child has been adjudicated in need of assistance, the court convenes a conference,
which includes the child, the child's parent(s), the child's attorney, the probation officer, and
other persons set forth in M.G.L. c. 119, § 39G, including a representative from the family
resource center, if involved with the family, and staff from the Department. The purpose of the
conference is to make recommendations to the court on the appropriate treatment and services
for the child and family.

The Department may provide any recommended available services if, the Department
determines in its clinical judgment the services are appropriate for the child and/or the child's
family.
(3) If the court orders the Department to provide specific services, treatment or placement, the
Department shall notify its legal counsel. Until such time as the court's order is vacated,
changed, or dismissed, the court's order shall be complied with, if the services are available and
to the extent the Department is reasonably able to comply.
