Severability

The provisions of 114.5 CMR 4.00 are severable, and, if any provision of 114.5 CMR 4.00 or application of such provision to any operatingagencyor fiscalintermediary in any circumstances shall be held to be invalid or unconstitutional, such invalidity shall not be construed to affect the validity or constitutionality of any remaining provisions of 114.5 CMR 4.00 or application of such provisions to operating agencies or fiscal intermediaries in circumstances other than those held invalid.
