Transfer of Prescriptions

(1) A pharmacy shall transfer a prescription to another pharmacy, at the request of a patient or his or her agent, in a timely manner so as not to delay patient therapy. (2) The pharmacy may act as the patient's agent in order to facilitate a transfer. (3) A pharmacy may not charge a fee for transferring a prescription. (4) Schedule VI. (a) A pharmacy shall transfer prescriptions for Schedule VI controlled substances in the same manner as prescriptions for Schedules III - V controlled substances. (b) Prescriptions for Schedule VI controlled substances may be transferred up to the maximum number of remaining refills authorized by the prescriber. (c) A pharmacy may not transfer a prescription authorizing refills for Schedule VI controlled substances more than one year from the date the prescription was issued.
