Rule 10-803. Augmented Estate

(a) Generally. A trust that is revocable at the time of death of the settlor is part of the decedent-settlor's augmented estate for the purposes of calculating the estate subject to election by a surviving spouse pursuant to Code, Estates and Trusts Article, Title 3, Subtitle 4. (b) Duties of Trustee. On receipt of a written request by the decedent-settlor's surviving spouse, the trustee of a revocable trust shall deliver all information necessary to calculate the elective share. Cross-reference: Code, Estates and Trusts Article, § 3-409. (c) Value and Sources of Payment. The orphans' court may issue orders that may be necessary to determine or modify the value or sources of payment of an elective share.
