Re: Lifting of the Prescription Medication Refill Waiver
On January 21, 2016, Governor Larry Hogan issued Executive Order 01.01.2016.01 declaring a State of Emergency starting at 7:00 am January 22, 2016 for the State of Maryland. On January 22, 2016, pursuant to COMAR 31.01.02.05, Insurance Commissioner Al Redmer, Jr., through Bulletin 16-04, activated COMAR 31.01.02.03A(3) for all health insurance carriers in the State which waived any time restrictions on prescription medication refills and required authorization of payment to pharmacies for at least a 30-day supply of any medication, regardless of the date upon which the prescription medication had most recently been filled.
On January 29, 2016, the State of Emergency for the State of Maryland was lifted; therefore, pursuant to COMAR 31.01.02.02, the waiver for the time restrictions on prescription medication refill waivers is no longer in effect.
