Per the new legislation, qualified applicants or policyholders may elect a full rejection of Personal Injury Protection (“PIP”) benefits. The Maryland Insurance Administration (“Insurance Administration”) is in the process of developing a form (or forms) as required by the new statute. Please note the following: If an insurer, other than MAIF, elects to not offer the option of a full rejection of PIP benefits to its qualified applicants and policyholders, the insurer may continue to utilize the current PIP waiver form. This form will remain available on the Insurance Administration’s website at: http://insurance.maryland.gov/Insurer/Documents/bulletins/2011pcforms-pipwaiverfinal.pdf. The Maryland Insurance Administration has received comments from industry on the design and content of new PIP form(s) and will consider these comments as the form(s) is developed and finalized. Once completed, the Insurance Administration will notify all stakeholders that the new form(s) are posted on the Insurance Administration’s website.
