STOLT DEPUTY ATTORNEYS GENERAL Dear Senator McBreairty and Representative Blodgett: In discussing your request for an opinion with regard to L.D. 286 relating to reco::-ding of land subdivision plans, under 30 M.R.S.A. § 4956, sub-§ 4, 3rd sentence, with Senator McBreairty, I was informed by him that L.D. 286 has been withdrawn from the Committee and that an opinion from the Office of the Attorney General is no longer required. There is still a question among some of the Committee members as to whether, under 32 M.R.S.A. c. 24, a person, not a professional surveyor, is restricted from land survey- ing even on his own property. The answer is that he is not. The prohibition is only against a person acting as a professional land surveyor within the intent of Chapter 24, when he is not registered as such, or who represents himself as such or as qualified to perform land surveying.
