STATE OF MICHIGAN DEPARTMENT OF INSURANCE AND FINANCIAL SERVICES Bulletin 2019-18-INS In the matter of: Enforcement of the Section 2105(6) Effective Date ___________________________________________/ Issued and entered This 14th day of October 2019 by Anita G. Fox Director This bulletin advises automobile insurers of the Director’s determination regarding enforcement of the effective date of Section 2105(6) of the Insurance Code (Code), MCL 500.2105(6). Section 2105(6) states that the amendments made to Chapter 21 by PA 21 and PA 22 of 2019 “apply beginning July 1, 2020.” This effective date conflicts with several sections in Chapter 21 that were amended to apply “after July 1, 2020”: i.e., July 2, 2020. To ensure that the no-fault reforms are implemented efficiently and consistently, the Director, pursuant to Section 205 of the Code, MCL 500.205, has chosen to exercise her discretion and will enforce a July 2, 2020, effective date for Section 2105(6).
