Rule 46. (1) Under authority of section 13536 of the act, the department may seek a court order enjoining violation of or directing compliance with the act or any rule or order issued thereunder. (2) Under authority of section 13535 of the act, a person who performs any act for which licensing or registration is required pursuant to these rules when that person is not licensed, registered, or exempted, is guilty of a misdemeanor and may be fined, imprisoned or both.
