Sec. 5. A plan that offers dependent coverage shall not deny enrollment to a covered individual's child on any of the following grounds: The child was born out of wedlock. The child is not claimed as a dependent on the covered individual's federal income tax return. The child does not reside with the covered individual or in the plan's service area.
