Bulletin 2017-2: Withdrawal of Administrative Bulletin 2015-4

Administrative Bulletin 2017-2 Date: October 25, 2017 To: All Health Plan Companies in the Small Group Health Insurance Market Subject: Withdrawal of Administrative Bulletin 2015-4 Employee Counting Method in the Small Group Health Insurance Market Beginning January 1, 2018, health plan companies will no longer be offering small group health insurance policies on MNsure, the Minnesota marketplace exchange. Accordingly, there is no longer a need to establish consistency in the small group counting methods for policies sold on the exchange and those compliant with longstanding state law. To maintain stability and consistency in Minnesota’s health insurance marketplace, for all policies sold in Minnesota for effective dates starting on January 1, 2018 and onward, health plan companies should comply with Minnesota Statutes section 62L.02 subdivision 13a to determine eligible employees for the small group health insurance market. Administrative Bulletin 2015-4 is hereby rescinded and withdrawn, and health carriers may no longer use the counting method defined in 45 CFR 155.20.
