A health plan must indicate in the certificate of coverage that enrollees have a right to a second medical opinion according to items A to C. A. A health plan must provide, at its expense, a second medical opinion within the health plan upon enrollee request. B. According to Minnesota Statutes, section 62D.103 , a health plan is required to provide a second medical opinion by a qualified nonparticipating provider when it determines that an enrollee's chemical dependency or mental health problem does not require structured treatment. C. According to Minnesota Statutes, section 256.045 , subdivision 3a, paragraph (b), a health plan must provide, at its expense, a second medical opinion by a participating provider or nonparticipating provider when ordered by a state human services referee.
