EX PARTE COMMUNICATION

With respect to the merits of any case not concluded, there shall be no ex parte communication between the board, including any member, officer, employee, or agent of the board who is employed in the decision-making process, and any party or intervenor. If ex parte communication occurs, the board may take whatever action fairness requires to remedy the effect of the ex parte communication consistent with this chapter and the statutory authority of the board.
