APPLICATION OF RULES TO EXISTING DIKES

These parts shall apply to all unauthorized dikes constructed in the past for the protection of those agricultural lands located within the floodplains of the Red River of the North and the Bois de Sioux, as defined in part 6115.1310 . Exceptions are farmstead dikes if they meet the provisions of part 6115.1370 . The commissioner shall have the authority to order removal, modification, or reconstruction of dikes not conforming to these parts.
