Kirkpatrick State Information Center 600 West Main Street Jefferson City, MO 65101 Dear Secretary Kander: This opinion letter responds to your request dated March 8, 2013, for our review under § 116.334, RSMo, of a proposed summary statement prepared for the petition submitted by Herman Kriegshauser regarding a proposed constitutional amendment to amend Article X of the Missouri Constitution, version 2 (2014-022). The proposed summary statement is as follows: Shall the Missouri Constitution be amended to create an individual and corporate state income tax credit of 60% of the amount donated to Missouri not-for-profit elementary and secondary schools or school districts and Missouri not-for-profit foundations providing scholarships for Missouri secondary school graduates to attend Missouri not-for-profit higher education colleges and universities (this credit cannot exceed the donor's state income tax liability for the year)?
