Dear Secretary Kander:
This opinion letter responds to your request dated December 21, 2016,
for our review under § 116.334, RSMo, of a proposed summary statement
prepared for the petition submitted by Bradley Bradshaw regarding a
proposed constitutional amendment to amend Article XIV of the Missouri
Constitution (2018-041). The proposed summary statement is as follows:
Shall the Missouri Constitution be amended to:
•
allow the use of marijuana for
medical
purposes, and create regulations and licensing
procedures
for
mariJuana and
mariJuana
facilities;
•
impose a 15 percent tax on the retail sale of
marijuana, and a tax on the wholesale sale of
marijuana flowers and leaves per dry-weight
ounce to licensed facilities; and
•
use funds from these taxes to establish and
fund a state research institute to conduct
research with the purpose of developing cures

and treatments for cancer and other incurable
diseases or medical conditions?
Pursuant to § 116.334, RSMo, we approve the legal content and form of
the proposed statement. Because our review of the statement is mandated by
statute, no action that we take with respect to such review should be
construed as an endorsement of the petition, nor as the expression of any
view regarding the objectives of its proponents.
