It does not have the force and effect of law, is not an evaluation of any specific facts or circumstances, shall not be considered a statement of general applicability, and is not binding on the Department. Nelson, Director ~y/)..~ Re: Implementation of House Bill 2372 and Senate Bill 878 On July 13, 2026, Governor Kehoe signed House Bill 2372 and Senate Bill 878. While these bills do not become law until August 28, 2026, several provisions may affect health coverage for Plan Year 2027. Accordingly, the Department is issuing this Bulletin to alert health carriers and all other interested parties to the provisions that will become law on August 28, 2026. Health carriers are encouraged to review these provisions to ensure compliance. Section 376.417 (HB 2372, SB 878): Enacts a new section of law relating to 340B drugs. Section 376.1183 (HB 2372): Amends an existing section of law related to mammography coverage. Section 376.1240 (HB 2372): Amends an existing section of law related to coverage of self-administered hormonal contraceptives. Section 376.1245 (HB 2372): Enacts a new section of law regarding payment for anesthesia services. Section 376.1280 (SB 878): Enacts a new section of law related to coverage of non­ opioid prescription drugs for treatment of acute and chronic pain. Section 376.1364 (HB 2372): Amends an existing section of law related to prior authorization. Section 376.1960 (HB 2372 and SB 878): Enacts a new section of law, "Nora's Law", which requires "health benefit plans delivered, issued for delivery, continued or renewed on or after January 1, 2027 and providing for maternity benefits to provide coverage for a prescribed home blood pressure monitoring device and home blood pressure monitoring device services for pregnant women or women within twelve months postpartum when determined to be medically appropriate in accordance with American College of Obstetricians and Gynecologists guidelines." The terms "home blood pressure monitoring device" and "home blood pressure monitoring device services" are defined in the law. The Department will work with health carriers on a case-by-case basis if a health carrier determines that policy form filings for Plan Year 2027 need to be amended or otherwise changed to comply with these new laws.
