Withdrawal or Dismissal of Petition

PURPOSE: This rule describes why and when a petition may be withdrawn or dismissed. (1) If the chair determines after an investigation that the petition has not been timely filed or that no valid question concerning the representation of employees exists in a prima facie appropriate unit, the chair may request the party filing such petition to withdraw the petition without prejudice or in the absence of such withdrawal, within a reasonable time, the chair may dismiss the petition.
