Stipulation
PURPOSE: This rule describes the scope of
stipulations and possible waiver of a public
hearing.
Upon written motion of the parties and with
approval of the presiding officer, the parties,
may stipulate to the facts and waive a public
hearing. The hearing examiner shall then
issue recommended findings of fact, conclusions of law and a decision and order to the
commission panel based upon the stipulation.
Where a commission panel hears the case, it
shall then issue findings of fact, conclusions
of law, a decision and order.
