Prohibition Against Payment of Temporary Assistance Benefits to a Person Found to Have Fraudulently Misrepresented Residence in Order to Obtain Assistance in Two or More States
PURPOSE: This rule prohibits the payment
of Temporary Assistance to a person found to
have fraudulently misrepresented residence in
order to obtain assistance in two or more
states.
(1) For the purpose of the administration of
the Temporary Assistance Program, the Division of Family Services shall not provide
assistance to or on behalf of an individual
during the ten (10)-year period that begins on
the date the individual is convicted in federal
or state court of having made a fraudulent
statement or representation with respect to
the place of residence of the individual in
order to receive assistance simultaneously
from two (2) or more states under programs
that are funded under Title IV (42 United
States Code section 601 et seq.), Title XIX
(42 United States Code section 1396 et seq.),
or the Food Stamp Act of 1977, or benefits in
two (2) or more states under the Supplemental Security Income program under Title XVI
(42 United States Code section 1381 et seq.).
The preceding sentence shall not apply with
respect to a conviction of an individual, for
any month beginning after the president of
the United States grants a pardon with respect
to the conduct which was the subject of the
conviction.
