Notification of Defects
PURPOSE: This rule provides a clarification
of filing officer’s duties relating to defects.
(1) Nothing in these rules prevents a filing
officer from communicating to a filer or a
remitter that the filing officer noticed apparent potential defects in a Uniform Commercial Code (UCC) record, whether or not it
was filed or refused for filing. The filing
office is under no obligation to do so and may
not have the resources to observe, identify, or
communicate such defects. The remitters are
responsible for the legal sufficiency of
records.
