Purpose. During the 2020 Regular Legislative Session, the Mississippi Legislature passed House Bill 773, "The Commercial Lines Modernization Act" (hereinafter "Act"). One of the provisions of the Act is an amendment Miss. Code Ann. § 45-45-27 to establish a two stop elevator exemption from the annual inspection requirement. This criteria for said exemption is hereby set forth below. # II. Criteria for Exemption. The owner of a two stop elevator may apply for this exemption from the required annual inspection if the following criteria have been met: 1. The elevator must have a MSID number as assigned to it by the MID Conveyance Safety Act Division; if the elevator does not have a MSID number, the MID Conveyance Safety Act Division will assign the elevator one. 2. The elevator must only have two (2) adjacent landings. 3. The Two Stop Elevator Extension Form, attached hereto, must be submitted to and approved by the MID Elevator Safety Division. 4. The exemption shall continue unless and until a material change is made to the subject elevator that would make said elevator ineligible for the exemption. Please note: Notwithstanding the above provisions, the MID Conveyance Safety Act Division reserves its right to perform an inspection of any elevator should there be a determination that it is in the interest of public safety for such an inspection to take place. 1 ### III. Effective Date. The provisions contained within this Bulletin shall be effective immediately. The elevator being exempted from annual inspections has only two adjacent landings. 2. The elevator must be registered with the Elevator Safety Division. 3. The elevator will not be inspected by a licensed Elevator Inspector. 4. No operating certificate will be issued. 5. Any liability protection gained from having the elevator inspected by qualified, licensed inspector will be lost. 6. The building owner will be responsible for having all ASME A17.1 code required annual and monthly testing performed by a licensed Elevator contractor. 7. The building owner will be responsible for compiling and maintaining the ASME A17.1 code required onsite documentation of test results, maintenance, and call backs and repairs. 8.
