### TRANSITION OF CERTIFICATION AND RE-CERTIFICATION OF PRIVATE UTILIZATION REVIEW AGENTS FROM THE MISSISSIPPI DEPARTMENT OF HEALTH TO THE MISSISSIPPI INSURANCE DEPARTMENT AND PROCESS

### I. Purpose and Scope.
The Mississippi Insurance Department (“MID”) is issuing this Bulletin to provide guidance to all private utilization review agents currently certified in Mississippi and all new entities intending to be certified in Mississippi on and after July 1, 2024, regarding changes to the utilization review process due to the passage of Senate Bill 2140, 2024 Regular Legislative Session.
### II. Senate Bill 2140.
With the passage of the Mississippi Prior Authorization Reform Act, Senate Bill. 2140, by the 2024 Mississippi Legislature, the responsibility for the certification of private utilization review agents in Mississippi was moved from the Mississippi State Department of Health (MSDH) to the Mississippi Insurance Department (MID) beginning July 1, 2024.
### III. Certification and Re-Certification Process
19 Miss. Admin. Code, Part 3, Chapter 19, a temporary rule entitled “Minimum Standards for Utilization Review Agents Regulation“, effective July 1, 2024, incorporates the most recent Minimum Standards for Utilization Review Agents as published by MDOH and certain related provisions of the Mississippi Prior Authorization Reform Act, Senate Bill 2140. At this time, no substantive changes have been made to the application requirements for certification or re-certification. All current certifications will be honored and renewed on the two-year anniversary date of certification. The filing fee remains $1322.50 and all checks should be made out to the Mississippi Insurance Department.

#### IV. Utilization Review Webpage
The MID has established a Utilization Review Webpage on the MID website. Please check the utilization review webpage on the MID website for additional information and any modified forms. Until new forms are published on that website, the current MSDH application forms and letters may be used. Any questions can be sent to utilizationreview@mid.ms.gov, or entities may call the Life and Health Actuarial Division at 601-359-3657.
#### V. Effective Date.
The provisions contained within this Bulletin shall be in effect on and after July 1, 2024.
