Emergency Rules

Emergency Rules. According to Section 25-43-3.108 of the Administrative Procedures
Act, an emergency rule may be adopted when an agency finds that an imminent peril to the
public health, safety or welfare requires adoption of the rule in a shorter period of time than is
required by Section 25-43-3.103. These rules may be effective for a period of not longer than
one hundred twenty (120) days and may be renewed for another ninety (90) day period.
Adoption of an identical rule under the normal process is not precluded.
