Confidential And Privileged Materials.
(a)
The Executive Director shall not produce documents in his possession if prohibited by
state or federal law. If the Executive Director intends to introduce any such document in
his case in chief, the Executive Director shall inform the hearing examiner and the
hearing examiner shall make appropriate orders regarding dissemination of such
documents. The hearing examiner may prohibit the admission of the evidence, or make
such orders as he deems necessary to limit dissemination of the document.
(b)
A respondent shall not further disseminate confidential or privileged materials except to
counsel of record in the action and necessary staff employed by counsel. Upon the
conclusion of the action, the respondent shall return all such materials and copies to the
Executive Director.
