As a condition of granting a permit, the Advisory Commission may recommend that the Executive Director require mitigation as a means of minimizing net adverse impacts on Coastal Wetlands. The magnitude of any mitigation requirement must be reasonably related to the magnitude of the activity under consideration. Where an area management plan is in force, the Executive Director will not require mitigation above and beyond that called for in the plan. In the absence of an area management plan, mitigation will be determined on a case-by-case basis. MISS. CODE ANN. §§49-27-23, 49-27-29.
