Upon meeting the thirty (30) consecutive day requirement, eligibility can extend back to the first (1st) of the month of application or the retroactive period provide the individual is otherwise eligible and resides in a title XIX facility. B. Exceptions to meeting the thirty (30) consecutive day requirement apply to an individual who dies prior to the thirty first (31st) day in continuous institutionalization and the individual who has income that does not exceed one hundred thirty-five percent (135%) of the federal poverty level.
