Court Order and Subpoenas Policy Dissemination of FBI and CIC records to a third party is prohibited by the Privacy Act of 1974 (5 U.S.C. § 552a) and Miss. Code Ann. § 45-27-1, et seq. This prohibition is subject to certain exceptions including the release of such records when the release is made “pursuant to an order of a court of competent jurisdiction” (5 U.S.C. § 552a (b) (11)). This exception has been interpreted to require the issuance of a subpoena or order by a judge.
