Statutory Moratoria and Exemptions — General Principle. Statutory moratoria and exemptions established by Miss. Code Ann. §§ 41-7-171 through 41-7-209 govern the issuance of Certificates of Need notwithstanding any provision of this Manual. The omission from this Manual of a specific moratorium or exemption does not eliminate or modify that moratorium or exemption. Where a statutory amendment modifies the scope of review, a moratorium, or an exemption, the amendment shall control notwithstanding any prior Department interpretation or determination.
