Financing Prohibition Prior to Certificate of Need. No person may enter into any financing arrangement or commitment for financing a new institutional health service or any other project requiring a Certificate of Need unless a CON has been granted for such purpose. This prohibition applies regardless of whether the person proposing the financing arrangement is the health care facility, an affiliate, a developer, a lender, or any other entity, if the financing arrangement or commitment is for a project that would require a CON. Only a CON issued pursuant to applicable law and this Manual satisfies the requirement of § 41-7-193(1).
