Failure to Implement

Failure to Implement. Failure to implement an approved project within the applicable Certificate of Need validity period and any authorized extension thereof may constitute grounds for expiration, rescission, revocation, or other action authorized by law, including the actions described in this Chapter. The Department shall follow the applicable procedures of Chapter 5 and this Chapter before taking any adverse action based on failure to implement.
