Denial of Extension — Hearing Right. If the Department denies a request for a six-month extension, the Department shall afford the CON-holder fifteen (15) calendar days notice within which to request a hearing. If a public hearing is requested, the Department shall conduct the hearing within forty-five (45) calendar days of receipt of the written request, utilizing the hearing procedures set forth in Chapter 5 to the extent practicable. A written request for such a hearing must be received no later than fifteen (15) calendar days from the date of the notice of denial and must be accompanied by the Six Thousand Dollar ($6,000.00) hearing fee deposit required by Rule 5.3. The State Health Officer shall render a written decision within thirty (30) calendar days following conclusion of any hearing on the denial of a six-month extension.
