Subjects Which May Be Addressed by Declaratory Opinions The Commission will issue declaratory opinions regarding the applicability of specified facts to a statute administered or enforceable by the Commission, a rule promulgated by the Commission, or an order issued by the Commission. The Commission will not issue a declaratory opinion regarding a statute, rule, or order which is beyond the primary jurisdiction of the Commission. "Primary jurisdiction" means: A. The Commission has a constitutional grant of authority in the subject matter, B. The Commission has a statutory grant of authority in the subject matter, C. The Commission has issued specific regulations impacting upon the subject matter, or D. The Commission has issued a specific order or orders impacting upon the subject matter. Source: Miss.
