Ex Parte Communications

Ex Parte Communications. No party or other person directly or indirectly involved in an Agency proceeding shall submit, to the Hearing Officer, any evidence, argument, inquiry, or advice, whether written or oral, unless such submission is made part of the record in the presence of all parties. Ex parte communications do not include submissions concerning strictly procedural matters or Agency materials which the Hearing Officer reviews in preparation for a hearing.
