Delinquent Children โ€“ In addition to prior approval, a child that has been adjudicated delinquent may not be placed in an interstate residential facility unless the following requirements are met: 1. The child must have been given a court hearing and an opportunity to be heard; 2. The childโ€™s parent(s) or guardian(s) must have been provided notice of the hearing; and 3. The court must have found the following: a. Equivalent facilities are not available in the Sending Agencyโ€™s jurisdiction and b. Institutional care in another jurisdiction is in the best interest of the child and will not produce undue hardship.
