Opinion No. 565 Fees-Filing Fees-Mines and Mining -Notice of Suspension of Work. HELD: A fee of fifty cents should be charged for filing notice of suspen- sion of work on mining claim. . June 30, 1934. You inquire as to the fee necessary to be charged where mining claimants file a notice relath'e to the suspension of work on mining claims between .July 1, 1933 and July 1, 1934. It is my judgment that this notice is not an affidavit of labor which must be recorded but is a notice to be filed and indexed. Under the provisions of the law it appears that same may be filed hy the payment of a fee of fifty cents as for filing a chattel mortgage, etc., "or other instrument required by la w to be filed and indexed, fifty cents." Section 4917, R. C. M., 1921. See Vol. 8, Reports and Official Opin- ions of Attorney General, p. 10.
