of Equipment.
Educational schools of a
company,
transported
by
truck, are not exempt from motor ve-
hicle licenses.

Mr. A. B. Middleton
Registrar of Motor Vehicles
Deer Lodge, Montana
You request my opinion as to what
license fees a tractor company must
pay in this state when, in conducting
an educational school at their dis-
tributor's places of business located
in the state, they transport their
equipment used in the schools by their
own trucks or in trailers towed be-
hind cars or by contracted trucks.
We do not believe that these facts
present any exception to the rules
stated in our opinion to you dated
September 10, 1935, No. 168, Volume
16, Opinions of Attorney General.
Such vehicles, so used, do not come
within the exception mentioned in the
answer to question No.1 in that opin-
ion as they are operated for compen-
sation or profit or are engaged in a
gainful occupation or business enter-
prise. If such equipment is not trans-
ported by contracted trucks but by
the owner itself, no motor carrier
freight license, in my opinion, would
be required.

and answer in opinion No. 168.
