Unemployment Compensation Act-
Administrative Fund-Authority of
Commission to Receive From Social
Security Board.
HELD: The unemployment com-
pensation commission is the proper
office to receive for deposit with the
State Treasurer. grants from the Social
Security Board of \Vashington. D. C,
to cover the administrative expenses
of the commission.

Dear Mr. Craighead:
You have requested my opinion as
to which is the proper office to receive
payment of grants to cover the ad-
ministrative expenses of the Unem-
ployment Compensation Commission
of Montana.
Section 10 (a) of Chapter 137, Laws
of 1937, known as the Montana Un-
employment Compensation Act, pro-
vides for the organization of a com-
mission to be known as the Unem-
ployment Compensation Commission
of Montana.
Section 13 (a) of said chapter, pro-
vides:
"There is hereby created in the
state treasury a special fund to be
known as the unemployment com-
pensation administration fund.
All
moneys which are deposited or paid
into this fund are hereby appropri-
ated and made available to the com-
mission.
All moneys in this fund
shall be expended solely for the pur- .
pose of defraying the cost of the ad-
ministra tion of this act, and for no
other purpose whatsoever. The fund
shall consist of all moneys appropri-
ated by this state, and all moneys
recei ved from the United States of
America. or any agency thereof, in-
cluding the social security hoard and
the United States employment serv-
ice, or from any other source, for
such purpose."
It is my opinion that the Unemploy-.
ment Compensation Commission is the
proper office to receive for deposit with
the state treasurer. grants from the
Social Security Board at Washington.
D. c., to cover the administrative ex-
penses of the Unemployment Com-
pensation Commission of Montana.
