Lindeen, Commissioner of Securities and Insurance Office of the Montana State Auditor / February 18, 2016 /; / /C//?iu: /.._,, ' I CLASSIFICATION REVIEW COMMITTEE FOR WORKERS COMPENSATION Montana Code Annotated § 33-16-1012 establishes the classification review committee's powers and functions. Specifically, § 33-16-1012(1)(b) states that the committee shall make the final determination regarding the establishment or revision of all classifications pursuant to Title 2, Chapter 4, Part 3. The purpose of this Memorandum is to advise insurers that a final determination made by the classification review committee is not binding on the office of the Commissioner of Securities and Insurance, Montana State Auditor (CSI). Pursuant to § 33-16-1026, the workers' compensation advisory organization must, among other things, file with the CSI rates and rating plans limited to prospective loss costs and the uniform classification plan adopted by the classification review committee. Under§ 33-1 6-1 028, the CSI must review each filing and determine whether a rate, which includes classifications, is improper or not in compliance with§ 33-16-1021 . Accordingly, the final determination by the classification review committee does not affect the CSl's review and ultimate disposition of rate filings.
