ROSENDALE – Commissioner of Securities and Insurance, Montana State Auditor Date: August 15, 2019 NOTICE OF NEW CONTRACT REQUIREMENTS FOR CONTRACTS WITH FEDERALLY CERTIFIED HEALTH ENTITIES The Montana Legislature enacted SB335 in the 2019 legislative session. SB335 is entitled “An Act Prohibiting Discrimination Against Federally Certified Health Entities in Certain Health-Related Contracts.” The Act was effective upon passage and approval and is enforceable against implicated parties. The Act applies to contracts and agreements signed on or after the effective date. This Advisory Memorandum is intended to place implicated parties on notice that the Commissioner has enforcement authority over the Act and will exercise regulatory authority over contracts and agreements found to be out of compliance with the law. Implicated parties are advised to ensure that new contracts and contracts up for renewal after the effective date of the Act conform to the new provisions of the law.
