ARM 24.11.490. LEAVE OF ABSENCE

(1) A worker is not eligible for benefits while on an employer-approved leave of absence until the leave of absence ends or the worker offers to return to work, whichever occurs first. (2) A separation from employment as defined in ARM 24.11.204 occurs when either the claimant or the employer determines the claimant is not returning to work for the employer. The separation may be a lay-off if the claimant offers to return to work and no suitable work is available.
