(1) Any employer, except state agencies specified in 39-71-403 , MCA, may elect coverage under plan no. 2 by owning an insurance policy that is in force, sold by a private insurance carrier authorized by the insurance commissioner's office to sell workers' compensation insurance in Montana. (2) Any employer may elect coverage under plan no. 3 by owning an insurance policy that is in force, sold by the state compensation insurance fund.
