ARM 37.49.204. IV-E FOSTER CARE ELIGIBILITY: INCLUSION IN THE FILING UNIT

(1) The child's IV-E eligibility is based on the total countable income and resources of all members of the filing unit in the month of eligibility. (2) Except as provided in (3) below, the following individuals must be included in the child's filing unit: (a) the child for whom IV-E eligibility is being determined; (b) any natural or adoptive parent of the child with whom the child was living in that month; and (c) any blood-related or adoptive brother or sister of the child with whom the child was living in that month, including half brothers or sisters. (3) The following individuals are not included in the child's filing unit: (a) individuals who are receiving supplemental security income (SSI) benefits; (b) stepsiblings; and (c) siblings over 19 years of age.
