ARM 37.82.438. MEDICAID REAL PROPERTY LIEN, RELEASE OF LIEN AFTER RECIPIENT'S RETURN HOME

(1) If a recipient upon whose real property the department has imposed a lien under 53-6-171 , MCA has been discharged from the facility and has returned home, the department shall upon written request file a release of the lien in the clerk and recorder's office. (2) The written request must contain the name and social security number of the recipient and must be accompanied by a copy of the legal description of the property subject to the lien. (3) The department may require reasonable documentation or verification that the recipient has been discharged from the facility and returned home.
