ARM 38.5.2712. ALTERNATIVE TO RATE SETTING

(1) To determine if any of the alternatives to rate setting listed in part (2) of this rule are appropriate, the commission shall consider the factor listed in 69-3-807(3) (a) -(e) , MCA. (2) If the commission determines that an alternative to rate setting is appropriate for the telecommunications service the commission may act as allowed in 69-3-807(2) (a) -(e) , MCA. (3) Twenty days prior to offering the service at a rate not set by this commission, the telecommunications provider shall inform current customers that the service will no longer be tariffed.
