ARM 42.2.105. RECORD OF DECLARATORY RULING

(1) The record in a declaratory ruling proceeding shall include: (a) the petition; (b) a statement of matters officially noticed; (c) if for good cause shown the department has held hearings on the petition, a stenographic record of the proceedings when requested by a party; and (d) the department ruling. (2) The stenographic record of oral proceedings or any part thereof shall be transcribed on request of any party. Unless otherwise provided by statute, the cost of transcription shall be paid by the requesting party. (3) Pursuant to 2-4-703 , MCA, the petitioner may appeal the declaratory ruling within 30 days to the district court.
