ARM 17.24.133. ENFORCEMENT: ABATEMENT OF VIOLATIONS AND PERMIT SUSPENSION

(1) The director shall immediately issue an order suspending the license or permit for each violation of the Act, this subchapter, the license, or the permit, that is creating an imminent danger to the health or safety of the persons outside the permit area. (2) The director may, after opportunity for an informal conference, suspend a permit or license for a violation of the Act, this subchapter, or the license or permit that: (a) may reasonably be expected to create a danger to the health or safety of persons outside the permit area; (b) may reasonably be expected to cause significant environmental harm to land, air, or water resources; or (c) remains unabated subsequent to the deadline contained in a corrective action order.
